Terms of Service

The rules for using AICaller responsibly, lawfully, and as a business service.

Effective July 1, 2026

1. Agreement and operator

AICaller is a brand operated by W3 Dev LLC, located at 1309 Coffeen Ave, Sheridan, Wyoming, United States. These Terms govern your access to AICaller's websites, applications, AI calling tools, phone numbers, trials, and related services.

By creating an account, starting a trial, purchasing a plan, or otherwise using AICaller, you agree to these Terms on behalf of the business you represent.

2. Business eligibility and availability

AICaller is offered for business use only. You must be at least the minimum legal age required to enter a binding contract in your jurisdiction and have authority to bind the business you represent.

The service is available globally where permitted by law, subject to the countries, telephone numbers, features, and providers listed in our current product documentation. You may not use AICaller where its use would be unlawful.

3. AI calling responsibilities

AI-generated speech and responses may be incomplete, inaccurate, or unexpected. You are responsible for configuring, testing, monitoring, and supervising your agents and for deciding whether their output is appropriate for your use case.

You must clearly disclose the use of an AI agent whenever required by law or when a person could reasonably believe they are speaking with a human. AICaller must not be used for emergency services or as a substitute for qualified legal, medical, financial, or other professional judgment.

4. Calls, consent, and recordings

You are solely responsible for establishing a lawful basis for every call and for complying with telemarketing, automated-calling, caller-identification, do-not-call, privacy, and consumer-protection laws in every applicable jurisdiction.

Before recording or transcribing a call, you must provide all required notices and obtain consent from every participant. You must honor opt-outs promptly and maintain any consent or suppression records required for your calling activity.

5. Acceptable use

You may not use AICaller to:

  • make unlawful, deceptive, harassing, threatening, or unsolicited mass calls;
  • impersonate another person or organization or manipulate caller identity;
  • facilitate fraud, discrimination, exploitation, or the sale of illegal goods;
  • collect sensitive information without a lawful purpose and appropriate safeguards;
  • interfere with the service, evade usage limits, or probe another customer's account;
  • make high-risk eligibility decisions without meaningful human review; or
  • violate a carrier, provider, or telephone-network policy.

We may suspend or terminate access when we reasonably believe activity is unlawful, unsafe, abusive, or harmful to the service or its providers.

6. Accounts and security

You must provide accurate account information, protect your credentials, and notify support promptly of suspected unauthorized access. You are responsible for activity performed through your account and for the people you authorize to use it.

7. Pricing and payment

Billing is based on the pricing and usage terms displayed on the AICaller website when you purchase or use a paid service. Payments are non-refundable.

8. Your content and our service

You retain ownership of the scripts, instructions, recordings, transcripts, and other content you provide. You grant AICaller the limited rights necessary to host, transmit, process, and secure that content for the purpose of providing the service.

AICaller and its licensors retain all rights in the service, software, design, models, documentation, and branding. These Terms do not transfer any ownership rights to you.

9. Service changes and availability

We may update, limit, or discontinue features to improve security, comply with law, or respond to provider and network changes. We do not guarantee uninterrupted or error-free availability.

10. Disclaimers and liability

To the extent permitted by law, AICaller is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, or that AI output will be accurate.

To the extent permitted by law, AICaller will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or claims arising from your calls. AICaller's aggregate liability will not exceed the amount you paid for the service during the three months preceding the event giving rise to the claim.

11. Indemnification

You will defend and indemnify AICaller against third-party claims, damages, and reasonable costs arising from your content, calling activity, violation of these Terms, or violation of applicable law or another person's rights.

12. Termination

You may stop using AICaller at any time. We may suspend or terminate access for a material breach, non-payment, legal requirement, security risk, or conduct that could harm AICaller, its providers, or other users. Provisions that by their nature should survive termination will remain effective.

13. Governing law and changes

These Terms are governed by the laws of Wyoming, without regard to conflict-of-law principles. We may update these Terms as the service or law changes. Material updates will be posted with a new effective date.
